Who must enroll in these courses?
In California, those found guilty of the following traffic crimes are required to attend a DUI program:
- driving under the influence drugs or alcohol (DUI)
- driving with a blood alcohol content (BAC) of 0.08 percent or higher
- “Wet reckless” charge for underage DUI with a BAC of 0.05 percent or higher (often negotiated as a plea bargain from DUI charges)
- All California driving violations involving alcohol or drugs
First Offender Program
If you are a first offender, you should contact a first offender program provider immediately, as you are probably eligible for your restricted license before you even have your first court date. The length of the DUI program you will be required to complete will depend on what your blood alcohol content (BAC) was at the time of arrest, as well as any prior records of a DUI conviction. Depending on the type and location of your conviction, first-time offender programs can last anywhere from six weeks to thirty months.
As a condition of the court lowering your charge, you must complete a 12-hour DUI program spread out over six weeks. This applies if you are found guilty of a “wet reckless” crime (first time), and the program is a result of a plea agreement negotiated by your DUI defense lawyer.
Minors who are under 21 and receive their first California DUI conviction may also qualify for the same program.
If your BAC is less than 0.15 percent AND this is your first DUI conviction in the last ten years, you must complete three months of mandatory DUI classes.
You must spend six months in the required DUI program if your BAC is between 0.15 and 0.19 percent and this is your first DUI conviction in the past ten years.
You might have to go to DUI school for nine months if your BAC was over 0.20 percent or if you refused a chemical test after being detained.
Multiple Offender Program
You will be required to complete an 18- or 30-month DUI education program if you receive a second or subsequent DUI conviction within ten years of a prior DUI or wet reckless conviction.
