You may be referred to court mandated addiction treatment if you’ve been charged with DUI. This would likely be an alternative to incarceration. Therapeutic interventions such as formal substance abuse treatment may be included in court mandated DUI treatments. These treatments target the consequences of substance abuse and the abuse itself.

Pass or Fail DUI Test

You will either pass or fail when you take a DUI test. You may be arrested by a law enforcement officer if you fail. To resolve your charges, you may need to go through the judicial court system after your arrest.

Designed for people who have nonviolent alcohol and drug charges, a specialized part of the court system is referred to as “Drug Court”. This can include felony and misdemeanor charges.

DUI/DWI Court Ordered Treatment

As an alternative to traditional sentencing, one form of treatment for substance abuse requisitioned by the court is “court ordered DUI treatment”. While under simultaneous judicial supervision, this treatment form offers chemically dependent offenders the opportunity to address their underlying dysfunction and illness. When compared to probation or incarceration, this model of treatment is believed to be beneficial for the offender, as well as the overall safety and health of the public.

Substance Abuse Programs

Substance abuse treatment that is court ordered may exist in the following forms:

  • Drug counseling
  • Individual therapy
  • Group therapy
  • Drug court programs
  • Outpatient rehabilitation
  • Inpatient rehabilitation
  • Or combination of the above options

Other criminal behavioral issues may also be addressed in court ordered treatment for DWIs and DUIs through anger management counseling and other services. Private insurance is accepted by some rehab centers (as well as other forms of payment) while others are state funded. As a result of the global health pandemic – COVID-19 – telehealth rehab services are being offered by some rehab centers. More on that later.

Following Treatment

Particularly in programs lasting 90 days or more, treatment for substance abuse has proven to be very effective. You may be required to follow certain protocols after completing inpatient treatment. Depending on the state you live in and your specific charges, this can vary.

In some cases, to prevent vehicle operation when alcohol is found on the breath of a driver, a device is installed on the driver’s car. The time during which this device would remain installed can vary. Other additional court-ordered recommendations may include the following:

  • Continual medication monitoring
  • Individual therapy
  • AA/NA meetings
  • … and more

Avoiding Imprisonment

You may be offered the chance to attend treatment for alcohol rehabilitation – in some cases – rather than serving a jail sentence. This is not applicable in every case or situation. The following variables can determine your eligibility:

  • The state in which you live
  • Age
  • Specific charges
  • Criminal history

You may be more likely to attend rehab as an alternative to jail if the following variables exist:

  • In an outpatient setting, you can receive treatment.
  • As your primary substance abuse, you designate “alcohol”.
  • You have never before attended treatment for substance abuse.
  • You are 25 years of age or less.

Once again, however, this does not apply to every person in every situation.
