A first-offense DUI conviction carries with it numerous fines, penalties, license suspensions (dependent upon your state), and more. As harsh as the punishment may seem to those convicted of their first DUI, rest assured that those convicted of second, third, and fourth offenses will have penalties of a much harsher nature inflicted upon them by the court. Prison or jail time could well be in the picture for some.
If you are facing the possibility of a subsequent or second DUI conviction, what might your future hold? We are going to answer that question with a little bit of information that will be not only informative but, hopefully, helpful, as well.
Subsequent or Second DUI Convictions
As just stated, the harshness of the penalties escalates with every DUI offense following your first conviction. The following can be the result of a second conviction:
- Two-year suspension of your driver’s license
- Fines from $390-$1000
- A jail term of 90 days to one year
Just for the record, let’s look at some additional DUI convictions and penalties…
Third conviction:
- License suspended for three years
- Fines of $390-$1000
- 120 days to a year jail time
Additionally, by this time, for three years after your conviction, you’re considered a habitual offender. If, within a 10-year period, you’re convicted of a 4th DUI offense or more, it will be considered a felony.

Fourth conviction:
- License suspended for four years
- Fines of $390-$1000
- 180 days to one year in jail, or 16 months in jail, or 2 to 3 years in prison
Getting Your Driver’s License Back
If you are convicted of a 4th, 3rd, or even 2nd DUI offense, the reinstatement of any driving privileges will be more difficult (the more offenses you rack up). For license reinstatement, you will have to do the following:
- You may possibly be required to have installed in your vehicle, an ignition interlock device. In order for you to operate legally, this may be the only way.
- Show successful court ordered alcohol treatment completion.
- Provide documentation of effective auto insurance.
